Approval of the new ECA for Air in Peru

On the 7th of June 2017, the new Environmental Air Quality Standards (Estándar de Calidad Ambiental), ECA for air were published under the Peruvian Supreme Decree Nº 003-2017-MINAM (link in Spanish). This law derogates the previous legal frameworks (ECA for air and complementary provisions), compiling most parameters and values but issuing a substantial change in the value for sulphur dioxide.

Principal modifications in the new ECA for Air

  • Sulphur dioxide: The value of 20 mg/m3 is modified to 250 mg/m3 for a period of 24 hours.
  • Particulates with a diameter of less than 10 microns (PM10): The value of 150 mg/m3 (NE more than 3 times per year) is modified to 100 mg/m3 (NE more than 7 times per year) for a period of 24 hours.
  • Ozone: The values is modified from 120 mg/m3 to 100 mg/m3.
  • The parameter total gaseous mercury will be incorporated and will take effect upon the publication of the National Air Quality Monitoring Protocol in Peru.
  • The parameter for Total Hydrocarbons (HT) has not been considered as Hexane.

Highlights of the new legal disposition on ECA for Air

  • The ECA for air is an obligatory reference for the design and application of the Environmental Management Instruments (Instrumentos de Gestión Ambiental) (IGA) and is applicable for the parameters that form the emission properties for manufacture, extraction and service industries.
  • The application of the ECA will be completed in the modification or updating of the IGAs.
  • The administrative procedures initiated prior to the publication of this standard shall be governed under the ECA in force at the time of the initiation of administrative proceedings.
  • A period of 180 days is established for the MINAM to approve the National Air Quality Monitoring Protocol.
  • A period of 90 days is established for the MINAM to approve the guidelines to strengthen and incorporate Provincial Environmental Technical Study Groups (CAM) within the framework of the National Environmental Management System.
  • Priority Zones of Attention are defined as the populated centres with economic activities, vehicular traffic or urban dynamics with an impact on air quality. A period of 120 days is established for the MINAM to develop the guidelines for determining Priority Attention Zones.
  • It is indicated that the Plans of Action for the Improvement of Air Quality in Lima and Callao will be formulated by the Multi-Sectoral Committee on Management of the Clean Air Initiative for Lima and Callao and approved by the MINAM. The plans of the other provinces shall be approved by the Local Government Ordinance of the competent authority.
  • The state of National Alerts for air contamination will be declared by the Ministry of Health (MINSA).
  • The Clean Air Initiative Management Committee for Lima and Callao becomes a multi-sectoral commission of a permanent nature attached to the MINAM, chaired by the Vice-Minister of Environmental Management and composed of representatives of the Minam, Ministry of Production (PRODUCE), Ministry of Energy and Mines (MINEM), Ministry of Housing, Construction and Sanitation (VIVIENDA), Ministry of Transport and Communications (MTC) , Ministry of Health (MINSA), National Service of Meteorology and Hydrology (SENAMHI), Metropolitan Municipality of Lima, Provincial Municipality of Callao, the National Confederation of Private Business Institutions (CONFIEP) and the Peruvian Association of Consumers and Users (ASPEC).
  • The role of the multi-sectoral Commission for the Management of the Clean Air Initiative for Lima and Callao will be to issue the technical reports containing the proposals for inter-institutional coordination mechanisms and modifications to the normative aimed at improving the air quality of Lima and Callao.
